Louisiana has had a wave of legal changes recently, and truck accident claims are directly affected by the timing of your crash.

  • Act 423. This one doubled the filing window, from one year to two, effective July 1, 2024. Crashes before July 1, 2024, still carry the old one-year deadline. Crashes on or after that date give you two years to file. La. Civ. Code art. 3493.11
  • Act 275. This is the direct action change, effective August 1, 2024. Demands and lawsuits now go to the driver or the motor carrier, and the insurer is addressed separately. Act 275
  • Act 16. No-Pay, No-Play rose to $100K/$100K, effective August 1, 2025. An uninsured driver cannot recover the first $100K in bodily injury or property damage.
  • Act 15. On January 1, 2026, Louisiana adopted a 51% comparative fault rule. If you are 51% or more at fault, you recover nothing. Below that, your recovery is reduced by your share of fault.
